Financial Services Litigation (State and Federal Practice)

BNS is nationally known for its expertise in financial services litigation. The firm's attorneys regularly defend clients who are being sued for a wide variety of financial services issues including fair debt and fair credit reporting violations (both state and federal claims), identity theft and privacy claims, consumer deceptive trade practices claims, usury and other consumer protection statutory or common law claims. This industry is often targeted in class action law suits and BNS's wealth of knowledge and expertise in handling such claims benefits and serves its clients as well. Additionally, the firm maintains an active consulting practice in this area, which gives its clients the ability to seek advice on regulatory and administrative issues that are prevalent in the financial services field. The firm is also actively engaged in alternative dispute resolution forums, such as arbitration and mediation, and can offer you those options if appropriate.

BNS's counsel focuses primarily on representing creditors, lenders, third-party debt collectors, debt buyers and other entities involved in the credit, collections, debt buying and credit reporting industries. Because of their experience in the field, BNS lawyers frequently appear in state and federal court for the jurisdictions in which the firm's lawyers hold licenses. Over the years, the firm has developed a strong network of referral attorneys throughout the nation and, in those jurisdictions in which the firm is not licensed, our lawyers can assist you in locating adequate local counsel and provide personalized and expert assistance to such counsel.

BNS's lawyers who practice in the financial services area are nationally recognized experts in the field. Manny Newburger, a founder of the firm, is a frequent author and speaker in the field. In addition to his litigation support and consulting practice throughout the United States, Mr. Newburger is often asked to consult and conduct training sessions abroad. Barbara Sinsley, after years of working in-house for one of the largest debt buyers in the United States, currently serves as outside General Counsel for DBA International, a national trade group for the debt buying industry. Barbara Barron and Temple Ingram are involved in triaging and monitoring clients' claims and cases on an ongoing basis in order to assist those clients in resolving disputes as expeditiously and inexpensively as possible.
